Analysis on the Judicial Value of Practical Reason

纵观现今法学的学术研究,大多是围绕着对某一法律制度或是某一单个法条所进行的。虽然这样的研究能够为法律的完善提供很大的帮助,但法律最终是需要实践的,而不是单纯的通过理论上的构想就能够完全适应社会需求。因此,需要我们转换视角,将研究方向由立法中心主义向司法中心主义转变,这个过程也体现了实践理性在司法中的价值。

Most of the legal academic researches always analyze on single legal system or law. Although the law can be perfected by this kind of study,it needs to be practiced to adapt to social demands rather than only through theoretic conception. Therefore, we need to change the angle of research, that is to say,to change the perspective from the legislative point to judicature＇s point, and this process also reflected the value of practical reason in the judiciature.
