《侵权责任法》的实施并没有解决我国"医疗损害鉴定二元制"。在《侵权责任法》实施的两年来,各地区结合其实际情况,对医疗损害鉴定的实施主体与实施程序都进行了进一步的探索与实践。本文将介绍江苏省医疗损害鉴定制度的特点,并结合具体实施情况,探讨由医学会承担医疗损害鉴定的必要性,同时对医学会更好的实施医疗损害鉴定提出相关建议。

The issue of Tort Liability Act does not solve the binary problem of the medical damage identification. During the past two years, combined with actual situations, different regions have been further exploring and practicing the subject and the procedure of the medical damage identification. This article will introduce the practice of Jiangsu Province, discuss the necessities of conducting by the Medical Association, then give suggestions on better conducting the medical damage identification.
