摘要 根据我国现行法律的规定,建立劳动关系时,应当订立书面劳动合同,但是在现实实践中,由于利益的驱动,存在用人单位以简单的口头形式与劳动者建立劳动关系的情况,导致事实劳动关系的大量存在。事实劳动关系的法律规制亟待解决。本文主要围绕事实劳动关系的概念、产生原因和类型,通过案例进一步分析提出了对事实劳动关系的法律规制。 According to the present law of our country, when establishing work relations, it is neces- sary to sign written contracts. But in reality, due to the drive of interests, there are employing units estab- lishing work relations with employees in the form of oral contract, which leads to the existence of many factual work relations. Therefore, it is urgent to make the legal regulations of factual work relations. This article analyzes and puts forward the legal regulations for factual work relations mainly revolving around the concept, reason and categories of factual work relations by making case studies.
