论社会保障权存在的两个正当性理由

On Two Legitimacies of Social Security Right

现代社会已经把社会保障权作为一项基本权利通过宪法、国际人权文件等形式确认下来,社会保障权的存在有两个正当性理由,一是实现"民主的平等"的正当性(趋向平等的正当性),二是作为个人权利的正当性。社会保障权反映了个人权利与平等之间的一种逻辑关系:不是达到了平等才能实现个人的权利,而是在完善个人权利的保障过程中趋近平等。社会保障权是"通向平等的权利"基石。

Social security right, as a fundamental right, has been recognized by the Constitution and international human right documents in modern society. There are two reasons for legitimacy of its existence. One is the legitimacy of democratic equality （ trend equal legitimacy）, and the other is the legitimacy of individual right. The social security right reflects a logical relationship between individual rights and equality, which is not the individual right achieved by equality, but trend equality achieved in the improvement of individual right protection. The social security right is the cornerstone of the ＂gateway to equality right＂.
