民生经济的现实意义在于公平分享,其实质内核契合了经济法形式公平与实质公平的价值追求。在经济转型时期,现行的经济制度、社会制度、法律制度所产生的系列问题对实现民生经济公平理念造成了制度障碍,体现为收入分配不公、政府权力行使不当、弱势群体利益保障机制不完善等。形式公平的价值目标要求政府经济权力的行使遵守功能合理和程序正义;实质公平的价值目标要求改革收入分配失衡的经济体制,实现对弱势群体的倾斜性保护。

The significance of livelihood economy lies in its fair share.Its core value corresponds to the pursuit of formal fairness and substantive fairness of the economic law.In the period of economic transition,the series of problems arising from the existing economic system,social system,and legal system present institutional barriers to the realization of the concept of justice in livelihood economy,reflected in inequitable income distribution,abuse of government power,the imperfect guarantee of the interests of the disadvantaged groups,etc.The value goal of formal fairness requires the execution of the government＇s economic power to conform to reasonable function and procedural justice;whereas the value goal of substantive fairness calls for the reform of the economic system flawed by unbalanced income distribution,so as to better protect the disadvantaged groups.
