Study on Related Issues of the Crime of Detention

非法拘禁罪是指以拘押、禁闭或其他强制方法剥夺他人人身自由的行为。近些年来,人权问题得到社会的普遍重视,然而非法拘禁案件却有着逐年增多的趋势,随之也使一些问题浮出水面,比如婴儿、精神病人能否成为本罪的对象、非法拘禁罪的结果加重犯、转化犯以及从重情节、索债型非法拘禁等相关问题,因此解决这些问题就成了研究本罪的重点。

Illegal detention is the crime that deprive people of the freedom in imprison,incarcerate or the other force.Recently with more attention put on the civil right,on the contrary,the number of the illegal detention is rising which make some issue on our face,for example,can infant and mental patient be the object of the illegal detention,the aggregated consequential offense and conversion,the case of heavier punishment,imprison somebody illegally for the debt etc,so figure out all these questions is the key point of this crime＇s research.
