摘要
继《关于办理刑事案件排除非法证据若干问题的规定》(本文简称非法证据排除规定)就认定和排除非法证据作了较为详细的规定后,2012年3月14日第十一届全国人民代表大会第五次会议通过对刑事诉讼法的修改决定,用"五条八款"确立非法证据排除规则,确立了非法证据的排除程序,明确了检察机关的证明责任。现有检察机关承担非法证据排除的证明责任方式能否有效地遏制刑讯逼供等非法取证方法,应冷静客观地分析和评价,对可能存在的某些不足寻求实践解决及制度完善的路径与方法。
After 'the regulation regarding the certain problems of the exclusion of the illegal evidence in handling criminal cases'(hereafter referred to the regulation of the exclusion of the illegal evidence) which provides the identification and exclusion of the illegal evidence in graphic detail,the 5th meeting of the 11th National People's Congress passed a decision about the revision of criminal procedure law on 14th March,2012.This revision utilized 'five articles and eight paragraphs' to establish the regulation of the exclusion of the illegal evidence and the proof responsibility for the procuratorial organ.However,whether the presently pattern of proof responsibility for the exclusion of the illegal evidence the procuratorial organ shoulder is efficient to curb the proliferation of extorting confessions by torture or not,we should analyze and evaluate critically and reasonably,then presenting improvement methods or approaches for the reality and mechanism according to the possible weaknesses.
