意见证据规则是证据规则的重要内容之一,立法上对意见证据规则作出明确规定并在司法实践中进行合理运用,是准确价值的合理要求,同时也是实体公正和程序公正的体现。司法实践中的意见包括外行意见与专家意见,而意见证据规则的适用对象主要针对外行意见,即在司法证明活动中,外行意见因为其本身不具有可采性而被排除使用。针对全盘否定适用意见证据的司法现状,以讨论意见证据在特定情形下的可采性标准为基点,是明晰与规范意见证据规则的关键所在。

Opinion evidence rule is an important part of the rules of evidence,making specific provisions on the opinion evidence on the legislation and making reasonable use of it in judicial practice are the demands of the value of preciseness and also the reflection of substantive justice and procedural fairness.The opinions in the process of judicial practice include the layman opinion and expertise,while opinion evidence rule is applicable for the layman,for that in the judicial practice the layman opinion will be excluded because of not having the admissibility.For the Judicial status of negating all the applicability of opinion evidence,discussing the standard of admissibility anchored in specific circumstances,is the sticking point of clearing and regulating the opinion evidence rule.
