法学本科教育与应对司法考试的反思——以哈尔滨理工大学法学专业毕业生司法考试调研报告为基础

Reflection of the Legal Undergraduate Education and Judicial Examination's Countermeasure——Based on the Research Report of Harbin University of Science and Technology Legal Graduates Judicial Examination

法学是实践性较强的学科,但现实中出现就业难的窘境,而司法考试是大多法科学生就业的敲门砖。司法考试与法学教育的关系应该是协调发展,尽管司法考试对法学教育有一定的冲击,但法学教育也在应对司法考试中应作出适时调整。法学本科教育的目的离不开对学生法律知识的传授和法学思维的培养,而司法考试的目标是选拨能解决实际法律纠纷的实务人才,需将二者有机结合,只有如此,法学本科教育和司法考试才能达到完美的契合的理想状态。

Law is a practical discipline,but there is employment difficult dilemma in reality.Judicial examination is the stepping-stone of most of the law students＇ employment.The relationship of judicial examination and legal education should be coordinated development.Although judicial examination certain impact on legal education,legal education also should timely adjustments,dealing with the judicial examination.The purpose of the legal undergraduate education is inseparable from the culture of the imparting of students＇ legal knowledge and the legal thinking,and the goal of the judicial examination is a selection of new practice personnel to solve practical legal disputes.We need combine them.Only in the case,the legal undergraduate education and the judicial examination could achieve the perfect the ideal perfect fit state.
