隐私权的宪法学分析

当今社会伴随着信息技术迅猛发展,出现了越来越多的侵犯隐私权事件,如著名的陕西"黄碟"案、深圳"电子眼事件"等。这些事件无一不说明我国对保护隐私权存在不足。事实上,自美国宪法判例确认隐私权基本人权的地位以来,许多国家亦纷纷以宪法之根本法的地位确认隐私权。我国作为信息发展大国,面对新世纪、新挑战,应该积极准备,多方学习,不仅要学习国外保护个人信息的技术,而且要借鉴国外保护隐私权的法律与制度。我国目前对隐私权的保护尚停留在民法领域,因此,积极研究隐私权的宪法层面的问题,为隐私权入宪做准备是必需而且迫切的。

Nowadays with the rapid development of information technology,there are more and more privacy incident,such as Shaanxi ＂huang die＂ case,Shenzhen ＂electron optics events＂ and so on.These events without showing our country to protect privacy problems.In fact,Since the United States constitutional Legal precedent confirmation the privacy rights status,many counties confirm the privacy right as Fundamental law of constitutional.China as a big information developing country,facing the new century,the new challenge,should Active preparation and learning.We are not only study the technology of personal information from aboard,but also draw lessons from abroad to protect privacy.At present our country on the protection of the right of privacy is still in the field of civil law,thus it is necessary and urgent that researching positive on privacy of constitutional field and preparing privacy for becoming a Constitutional right.
