摘要
随着社会的发展 ,我国对精神损害赔偿制度的立法已滞后于社会形势的发展 ,亟待完善。文章从精神损害赔偿的概念特征、适用范围、数额确定、现行立法的缺陷及完善四大方面阐述我国精神损害赔偿制度。
As the society develops,our country's legislation of spiritual compensation system lags behind the social development,and it badly needs to be improved.The article discusses about our country's spiritual compensation system around these four points:the concept feature of spiritual injury compensation,suitable area,to value the amout of compensation,the shortcomings and improvements of present legislation.
