摘要
劳动合约是农民工形态人力资本质量提升和发展和谐劳动关系的制度保证。本文基于新制度经济学思想,从农民工劳动合约的关系网络特点出发,构建适于我国农民工劳动合约关系的框架结构,从纵向和横向两个维度分析制约农民工劳动合约制度实施的各种关系结构,提出三方机制中政府主导作用的要求。
The labor contract system is institutional guarantees of the urban migrant workers (UMW) for its Rights and interests, quality of human capital, and harmonious of labor relations. This paper construct suit- able framework structure of Chinese UMW labor contract relationship, based on the ideology of the new insti- tutional economics, starting from the UMW' s Social- network characteristics, to analysis its elements and constraints of UMW' s labor contract system implementation from the two dimensions of vertical and horizon- tal, to propose the Government' s leading role in the tripartite mechanism, including the perfection of the legal system, enhancement of infrastructure, social contracts awareness and improvement, etc.
