信息维度下网络信息的司法认证规则研究

随着科学技术的发展、网络的全球普及化,以及信息化时代的推进,网络信息这一概念对人们来说已不再陌生。由于网络信息的种类繁多,且与传统证据有所不同,导致了对其认证方法、程序乃至可采性规则也有所不同。所以,一些适用于传统证据的司法认证规则并不适用于网络信息。学界对于网络信息的司法认证规则的探究目前尚属于初级阶段,相关法律规则也亟待完善。所以,深入研究网络信息的司法认证规则有利于解决网络信息作为证据凸显的诸多问题,便于诉讼中对网络信息的更佳认识和利用,对于与传统证据规则的比较研究更具重要意义。

With the development of science and technology, the global popularity of the network, and the propulsion of the information age, the concept of network information is no longer unfamiliar.A wide variety of network information, and different traditional evidence, leading to its certification methods, procedures, and even the admissibility rules are different.Some traditional evidence applicable to judicial certification rules does not of course apply to network information.The exploration of academic rules for judicial certification of network information is at a primary stage, and the relevant rules of law need improvement.So in-depth research of the judicial certification rules of network information is beneficial for the solution of many problems when network is used as evidence, and it is easy in litigation to better understand and use network information.It seems much more important when compared with the traditional rules of evidence.
