摘要
为建设以环境友好和资源节约为主要特征的生态文明社会,中国政府已经采取了一系列的环境监管措施,并基本形成了自己的环境监管模式,但是环境监管的绩效却无法体现在环境质量的明显改善和提高上。从法律制度上看,中国环境监管措施的制度选择和设计没有体现法律对和谐和生态效率的价值追求。提高环境监管效率,促进"两型社会"建设目标的实现,需要推动利益相关者就环境问题进行对话,设计与选择体现生态效率与和谐价值的环境监管措施,形成环保直接监管、间接监管和自我监管协同作用,公民社会、企业、环保部门和地方政府协同努力的局面。
To build an environment-friendly and resource-conserving ecological civilization,Chinese government has taken a series of environmental supervision measures and has basically formed its own environmental supervision patterns.However,the performance of environmental supervision is not reflected in the noticeable improvement in environmental quality.From the perspective of legal system,the institutional choice and design of China's environmental supervision measures do not reflect the value pursuit of harmony and ecological efficiency.To improve the efficiency of environmental supervision and achieve the goal of building an environment-friendly and resource-conserving society,it is necessary to encourage the stakeholders to have dialogue on environmental issues,design and select the environmental supervision measures that reflect the value pursuit of harmony and ecological efficiency,so as to form a synergistic effect for environmental protection featuring direct supervision,indirect supervision and self-regulation and to have joint efforts from civic society,enterprise,environmental protection department and local government.
