治理“双超”的行政法律问题探究——以哈尔滨阳明滩大桥引桥坍塌为例

Investigation on the Administrative and Legal Problems on Regulating the "Two-Overs" Phenomenon——With the Collapse of the Yangmingtan Bridge at Harbin as an example

货运汽车超载超限运输作为一个中国性的难题,它不仅造成了国家大量的运输税费的流失,加剧了运输行业的恶性竞争,也对公路桥梁等公共交通基础设施的正常使用,对广大人民群众的财产安全构成了极大威胁。近日,哈尔滨阳明滩大桥引桥坍塌事件再次引起了社会各界对"双超"治理问题的关注和思考。本文正是以这一事件为背景,在综合西方国家治超经验基础上,从法律角度对当前我国公路治超工作中的种种问题进行深层次分析,揭示其本质,为研究如何建立治理"双超"长效机制提供方法思路。

The overloading and over - limit of the freight cars is a Chinese problem. It not only causes the tremendous loss of transportation taxes, exacerbating the vicious competition in this industry, but also threatens the normal use of public transportation infrastructure such as roads and bridges, which further greatly damages the property safety of the masses. Recently, the collapse of the Yaugmingtan Bridge at Harbin again arouses the public attention to the issue of ＂Two Overs＂ （overloading and over - limit）. Taking this incident as the background and based on the western experience in dealing with this issue, this article, from a legal perspective, analyses all kinds of problems in the settlement of the ＂over＂ issues, in hoping to provide ideas and methods for the establishment of a long -term mechanism in regulating the ＂Two Overs＂ .
