清代庄氏家训的“准法律”作用

The Quasi-Legal Role of Family Regulation in the Qing Dynasty

天下之本在国,国之本在家。国家的正常运作需要家族来支撑和维系,国法的推行需要家法的补充和协助。通过检视鲁南地区庄氏家族的族谱、家训史料,可以发现家训的作用不仅限于对族人的教化约束,还体现出一种助力基层政府统治的"准法律"作用。这种"准法律"作用在族内、乡邻、家国三个层面均有所体现。其根源则可归于家训和朝廷律令背后的传统礼法观念。

In ancient China, the saying ＂the world is based on nations, nations are based on families. ＂ indicates that traditional Chinese nation and family share the same structure. Tile nation＇s normal operation needs the family to sup- port and maintain the implementation of national laws need family regulations to complement and help. Based on the Shandong Zhuang Family genealogy, the Zhuang Family disciplines and other historical？ records, according to previ- ous research, this paper tries to figure out how the constraints of the Zhuang family complement and support the con- tent of national law; Also, this paper plans to analyze the quasi-law functions in the family, among the neighbors, and between family and country; to dissect the characteristics of the Zhuang Family disciplines in comparison to other Family disciplines in South China; to analyze the interaction between etiquette and law behind the Zhuang Family dis- ciplines and national laws.
