对监禁刑向非监禁刑转化工作的思考

On Transformation from Imprisonment to nonimprisonment Penalty

我国在监禁刑向非监禁刑转化工作方面取得了一定的成绩,但总体上讲,我国有重监禁刑、轻非监禁刑的思想和司法现实。因此,我们应该大力在观念层面为非监禁刑鼓与呼,在立法层面为监禁刑向非监禁刑的转化减少障碍,并逐步扩大假释、暂予监外执行、缓刑、管制等非监禁刑的适用规模。

China has made certain achievements in transformation work from imprisonment to nonimprisonment penalty,but generally speaking,our country has thoughts and judicial reality of heavy imprisonment,light imprisonment.Therefore,we should vigorously call for imprisonment in the ideology,reduce obstacles in imprisonment to the conversion of imprisonment in the legislative level,and gradually expand the applicable scale of the parole,temporary execution outside prison,probation,and control.
