摘要
以古希腊哲学对形而上的思考为参考,考察《老子》之"道"的概念所包含的有关法律应然品性的法哲学,意图指出这种应然品性与古希腊的法哲学思想存在某种程度上的亲和性,亦带有高级法的特征。但由于形式要素的缺乏,以及现实中各种形而下因素的消解,导致"道"这一范畴无法发展为真正的高级法,由此也弱化了它对现实中国家权力与法律的批判性。
From the perspective of comparison gates the "Ought to Be" nature of Tao in Laozi them, and Tao also has certain characteristics o the erosion of history reality, the conception of between Chinese and ancient Greek philosophy, this paper investi- and makes f the higher Tao did not the conclusion that there are law. Anyway, because of the develop as a kind of higher some similarities between lack of formal factors and law, which makes it lose the criticalness to the realistic state power and law.
