摘要
当前,越来越多的劳动者尝试运用法律武器来解决劳动争议,劳动者一方起诉用人单位的案例数量呈现不断上升的趋势,其中"恶意诉讼"的比例更是陡然增多。本文从恶意诉讼的定义入手,对劳动者在劳动争议过程中可能出现的"恶意诉讼"行为归类并分析其中的原因,同时从国家、用人单位、国外经验等等角度提出了防范的建议。
With the gradual reinforcement of law in China, as well as improvement of legal consciousness of workers, more and more workers resort to legal means to resolve labor disputes, the number of case prosecuted by workers is increasing rapidly, among which malicious prosecutions take a large part. This paper starts from definitions of malicious prosecution, categorization of malicious prosecution, analysis of its causes, and suggestions and precautions from the perspectives of government, enterprises, and foreign experiences .
