中国特色社会主义法的价值作为中国特色社会主义法律及其体系的思想、观念与精神支撑,不仅为中国特色社会主义法律及其实践活动提供着伦理正当性与合法性的理性论证,而且对于法律理论和法律实践具有精神引导、观念变革和制度创新的积极意义,因而成为中国特色社会主义法律发展的根本性因素和强大动力。在中国特色社会主义法的价值体系中,秩序、自由、平等、人权、和谐、正义处于特别重要的地位。中国特色社会主义法的这些价值要素一方面表征和反映了人类法律文明与政治文明的基本价值共识即普世价值内涵,另一方面也表征和反映了中国特定的历史文化传统因素与中国现实的具体国情的因素。它们不仅包含于中国特色社会主义核心价值体系之中,而且也是中国特色社会主义核心价值及其体系在中国特色社会主义法律及其体系中的具体体现。

Socialist law with Chinese characteristics is the thinking, notional and spiritual support of so- cialist legal system with Chinese characteristics, providing the legal system of Socialist with Chinese charac- teristics and its practice with a rational ethical justification and legitimacy, bears positive significance for spiritual guidance, the concept change and institutional innovation of legal theory legal, and becomes a funda- mental factor and powerful engine in the law, development of Socialist with Chinese characteristics. In the val- ue system of Socialist law with Chinese characteristics, order, harmony, justice, freedom, equality and human rights are of particular importance. These elements of value characterization of Socialist law with Chinese characteristics reflect both the basic value consensus of human legal civilization and political civilization, i.e. universal value connotation, and China＇s specific historical and cultural tradition and China＇s concrete na- tional condition in reality. They are not only included among the core value system of socialism with Chinese characteristics, but also serve as the concrete expression of the core value of the socialism with Chinese char- acteristics and the Socialist legal system with Chinese characteristics.
