摘要
第二次世界大战后在联合国框架下建立的国际经济法律秩序相对战前局部的、零碎的国际经济法律秩序,是史无前例的变革。作为旧中国的合法继承者,新中国享有这一秩序变革的既得合法利益,因此不应全盘否定之。事实上,这一秩序连同联合国体系,在二战之后并未发生根本变革,而是呈现一系列渐进式演变。在世界贸易体制与国际货币金融体系这两个秩序构成的核心领域,渐进式演变尤为突出。中国应在渐变中求发展,维护和争取自己应有的权益,并继续与其他发展中国家共同努力,改革现行国际经济法律秩序的治理结构,建立一个公平合理的国际经济法律秩序。
Compared to the local and fragmentary international economic legal order before the World War Ⅱ, the postwar international economic legal order under the framework of UN is an unprecedented reform. As a legitimate heir of old China, new China enjoys legitimate interests of the reform of order, and thus should not be denied entirely. Actually, the new order along with UN system has experienced a series of evolution instead of radical reform. This article highlights how to promote development in the reality of evolution, safeguard and strive for their own rights and interests and continue to make great efforts with other developing countries to es- tablish a just and reasonable international economic legal order.
