期待可能性理论源于德国对"癖马案"的判例,具有重要的定罪、量刑和罪过的判定功能。期待可能性理论能指导我国刑事立法和刑事司法实践,目前在我国司法实务中已有一定的运用。
The expectancy possibility theory begins with the decision made by the German on case of the ＂addiction horse race＂.It has important functions such as conviction,sentencing and judgment of sin.It plays an important practical guiding role in our criminal legislation and criminal justice.In our country,there are some uses of expectancy possibility theory in judicial practice.
