摘要
网络时代,诋毁商誉的侵权主体更加隐蔽、分散,且损害后果非常严重。侵害商誉权的结果往往具有不可逆性,且存在责任几率的问题。诋毁商誉的损害赔偿责任不仅要能够恢复受害人遭受的损失,更重要的是要能够预防和遏制侵权行为的发生。惩罚性赔偿可以实现上述目的。惩罚性赔偿的数额应参考侵权行为人过错的性质、程度和侵权行为的动机、手段、持续期间以及责任几率确定。
In the Internet age,the tortfeator,who denigrates other's business reputation,is becoming more invisible,dispersed,and the damages of infringement are extremely serious.The consequences of infringement on the right of commercial goodwill are often irreversible.Meanwhile,there are the chances of liability issues.The compensation on infringing commercial goodwill should be able to compensate the losses suffered by the victim fully.It is more important that the liability should be able to prevent and curb the infringement.Punitive damages could achieve these goals.To determine the amount of punitive damages,there are several aspects that should be concerned,which includes the degree of subjective fault,motivation,means,duration,and the chance of liability at least.
