论我国环境公益诉讼主体资格的完善——基于检察机关的视角

Analysis on Perfecting the Subject in the Environmental Litigation——Based on the View of the Procuratorates

检察机关参与环境公益诉讼是行使民行检察职能的重要内容,该项工作的开展不能脱离检察机关民行工作的大局。我国不少学者在设计检察机关参与环境公益诉讼的制度时赋予了其过多的诉讼责任,忽视了检察机关民行检察职能的实际工作状态,这已经产生了一定的负面影响。当前,检察机关可以是参与环境诉讼的主力,但从长远来看应当充分发挥其他诉讼主体的诉讼作用。

It is an important content for the procuratorates to participate in the environmental litigation.This work is connecting with the whole procuratorial supervision system in civil proceedings and administrative litigation supervision.Many scholars made the procuratorates accept responsibility for the environmental litigation when they design the system.There already have an adverse effect on jobs because of the neglect of the characteristic feature of the procuratorate.The procuratorate should to be the main power in the litigation.The other litigation subjects also need give full scope to the litigation.
