摘要
重构中国的外商投资立法体系已成共识 ,中国加入WTO是其有利的外部因素。WTO协定中TRIMS协议和GATS协议在多边贸易体制中规定了国际投资问题 ,特别是其规定的国民待遇原则对中国外商投资立法的影响极大。
It is generally agreed that the system of Chinese foreign investment legislation should be reconstructed.WTO first brings the foreign investment problem into a multilateral trade system.The Agreement on Trade-related Investment Measures(TRIMS) and the General Agreement on Trade of Service(GATS) make great influence on Chinese foreign investment legislation.
