摘要
中国人民陪审员制度诞生于新民主主义时期,在历史上曾占有很重要的地位。2005年的立法与2010年的司法解释,从国家层面表明了推进与加强人民陪审员制度的态度。但在实践中,人民陪审员制度的运作却出现了应然与实然间的分离与差距,在实现民主、反映大众智慧、保障审判公正和诉讼效率等方面不能有效发挥其作用。针对以上问题,必须对人民陪审员制度进行与诉讼体制相结合的改革,从重视人员遴选、强化诉讼原则到发挥其身份优势等多方面对该制度予以完善。
The paper describes the match and deviation between ideal status and actual implementation ot ulmese people's assessor system in the field of trial justice, power supervision, and litigation efficiency, in particular during the re- cent five years since The Decision, which refines the contents of people's assessor system with the form of legislation, and enters into force in 2005. The reasons for the deviation are sorted out; and countermeasures are discussed to narrow down the gap between ought status and actual practice of assessor system. It suggests that reformation on combining assessor sys- tem with whole proceeding system should proceed.
