明晰农地产权界定 推动使用权流转——中国农地产权制度改革之我见

Clarifying the Definition of Farmland Property and Promoting the Circulation of Farmland use Right

本文从产权理论的角度分析了中国农地制度存在的弊端 ,研究了现实的制度创新实践 ,在对这些实践进行绩效评价的基础上提出了政策建议 :一是进一步明晰农地使用权的产权界定 ,建立以村为基础、乡统筹的农地产权制度 ,强化和稳定农户的土地承包关系。二是健全农地使用权市场和必要的土地流转中介组织 。

This paper,from the angle of property theory ,analyses the disadvantages of farmland system of China and makes a careful study of the present practice of institutional innovation.Based on evaluation some suggestions are put forward :firstly,further clarifying the definition of property right of farmland use right and establishing a village based and township planned farmland property system to reinforce and stablize farmland contract. Secondly,perfecting the market of farmland use right and necessary intermediary organizations for land circulation and establishing an effective system of land circulation.
