试论城中村改造中拆迁补偿利益主体的缺位与错位

Discussing on the Absence and Misplacement of the Beneficiary of Land Compensation for Reconstructing Villages Within Urban Areas

研究目的:研究拆迁补偿中利益分配的公平与公正问题。研究方法:文献资料法。研究结果:中国拆迁补偿中,特别是在城中村改造拆迁补偿中,存在着严重的利益主体缺位与利益主体错位现象。研究结论:应当允许集体土地使用权直接流转,在拆迁补偿中应当完善利益分配机制,加大行政执法力度。

The purpose of this study is to discuss the equity and fairness of benefit distribution in the land compensation during the reconstruction of villages within urban areas.Method of documents was employed.The result indicates that there are serious absence and misplacement of beneficiary of the land compensation,especially in reconstructing villages within urban areas.It is concluded that we should legalize the collective construction land transfer directly,and ameliorate the distribution system and intensify the administrative monitoring efforts.
