A Study on Non-Exclusive License of Software Copyright in the Internet Environment

通过对在网络环境下软件非独占许可特征及其可转让性的研究 ,提出了软件非独占许可贸易在网络环境具有网上交付和对被许可人实施监控的特点 ,认为软件版权转让具有“不破”非独占许可的原理 ,并且得出了软件非独占许可“使用权”

By researching on characteristics and transferability of non-exclusive license of software copyright in the Internet environment, the paper shows that the non-exclusive license trade of software copyright in the Internet environment features on-line delivery and monitoring effected by the licensor. It holds that the transfer of the license copyright keeps the principle of the ‘unbreakable’ non-exclusive license. It is concluded that the non-exclusive license of software copyright cannot be transferred.
