安全事故处理调查组的法律问题分析:以“7·23”甬温线特别重大铁路交通事故为例

On Legal Issues Concerning Investigation Team on Security Accidents: A Case Study of the Major Railway Traffic Accident on Yongwen Line

安全事故调查组在生产安全事故的纠纷解决中起着关键性的作用。"7.23"甬温线特别重大铁路交通事故处理中,安全事故调查组存在调查主体不明确、检察院参与机制不完善、调查过程信息不公开以及调查过程监督不完善等问题,对此需要从法律制度上予以解决,将调查组在调查事故真相、解决事故纠纷中的作用落到实处。

Investigation team plays a key role in the settling of disputes caused by security accidents. By analyzing the case of the major railway traffic accident on Yongwen line happened on July 23rd 2011, we found many problems to the current system, such as that the investigating principal is unclear, the procuratorate participation mechanism is inadequate, the investigation process is not open to the public, and the supervision of the investi- gation process is imperfect, which call for improvement from the legal sense. To resolve the accident disputes, investigation teams should fully implement their duty and bring the truth to light.
