″Participatory Administration″ and Development of Administrative Action Theory

随着我国行政民主化的推进和公民行政参与权的广泛运用,政府行政管理活动正在形成一种"参与式行政"的模式,这对行政行为提出了新的要求,也对传统行政行为理论提出了挑战。传统行政行为的单方意志性特征、合法要件理论以及效力理论等都缺乏"公众参与"的要素,因而需要加以反思并发展改进。

With the democratization of Chinese administration and citizen＇s administrative participation, the government administration management has been developed into a pattern of participatory administration, which has put forward new requirements on administrative action and posed new challenges to the traditional theory. The unilateral characteristic, lawful requirements and legal validity of the traditional administrative action theory are all in lack of citizens＇ participation. Therefore, it is necessary to reflect on and develop the traditional theory.
