宽严相济政策在涉台毒品死刑案件中的应用

On Application of the Policy of Tempering Justice with Mercy for Death Penalty in the Taiwan-involved Drug Case

近年来,福建沿海一带成了毒品犯罪分子将毒品走私出境到台湾的首选通道。鉴于涉台毒品犯罪的严峻形势、两岸关系的特殊性、当前世界刑罚的轻缓化对宽严相济的刑事政策提出了新的要求,司法实践存在宽严相济应用之不足等情况,亟待我们在应用宽严相济政策时做到:严中有宽:全面考量案件情节,区别对待惩处毒品犯罪分子;宽中有严:严格把握死刑案件的证明标准;宽严有度:慎重处理犯罪分子的立功问题;宽严审时:完善立法,坚持少杀、慎杀。

In recent years, the coastal areas of Fujian became the preferred channel for drug offenders to smuggle out to Taiwan. Concerning to the serious situation of Taiwan-involved drug crimes and the special nature of cross-strait relations, the current mitigation of punishment on the Policy of tempering justice with mercy meets with new requirement and its insufficient application still exists in the judicial practice. So we must urgently do the following： punishment with leniency： comprehensively take the case circumstance into consideration and differently punish drug criminals; leniency with punishment： strictly hold up the proof standard for death penalty. With appropriate and situational punishment and leniency, we must carefully handle criminal meritorious service problem, perfect legislation and sentence to death less with care.
