普通受贿罪与利用影响力受贿罪问题研究

On the Crime of Taking Bribes Taking advantage of the Influences

鉴于利用影响力受贿罪在认定上存在许多疑难和分歧,本文通过将该罪与普通受贿罪比较研究,在其犯罪客体、"利用该国家工作人员职权或地位形成的便利条件"和"为请托人谋取不正当利益"三个方面进行了探讨,以期能够在普通受贿罪的参照下对利用影响力受贿罪作出合理的认定。

There exist a lot of difficulties and disagreements in identifying the crime of taking bribes taking advan- tage of the influences. Through discussing this issue from the three perspectives of the object, the favorable condi- tion derived from taking advantage of the rights and status of national staff, and seeking illegitimate interests for trustees, the author hope to make reasonable standards to identify the crime of taking bribes taking advantage of the influences compared with other common crime of taking bribes.
