摘要
当今社会经济的发展迅速,人才流通日益频繁,与之相对应的是竞业禁止随着市场经济的扩大而不断蔓延,并逐步在雇主与雇员之间、业者与管理者之间签订的协议上占据了举足轻重的地位。但是由于相关法律制度设计不足,在权利平衡维系上存在着缺陷,导致正常商业运作的成本增大。因此,本文在对我国劳动法规中竞业禁止制度进行分析的基础上,提出相关的建议以供参考。
With rapid social and economic development and the frequent flow of talented personnel, the system of prohibition of business strife has become more and more important in the market economy. Stipulations regarding prohibition of business strife play a decisive role in the labor contract as regards employer-employee relations. However, owing to certain defects in the legal system, the relevant rights balance has not been supported effectively and as a result, business cost increases. This article presents an analysis on prohibition of business strife in Chinese labor regulations and relevant suggestions.
