摘要
《涉外民事关系法律适用法》是我国历史上第一部系统调整冲突法问题的法律,它吸收了先进的最密切联系原则理论,在法律的总则与分则中均有涉及。本文从最密切联系原则在中国法律适用法中的具体适用进行展开,分析该原则适用存在的问题,并针对其提出完善的看法。
Law of the Application of Law for Foreign-related Civil Relations of the People＇ s Republic of China is the first systematic law to adjust conflict in China, which absorbs the essence of the Doctrine of the Most Significant Relationship. The article shows how the Doctrine of the Most Significant Relationship applies the Law of the Application of Law and provides opinions about how to solve the problems arisen from the application.
