摘要
指出了应结合我国国情,参照国外相关立法规定,建立我国自己的雇佣人侵权责任理论。强调了在构建雇佣人侵权责任相关立法时,应根据公平原则,既要保护受害人的合法权益,也要让雇佣人的合法权益不受到损害;讨论了雇佣人民事侵权责任的构成要件。
Based on Chinese reality and the foreign related legislation as reference, this article points out that we should set up the theory of employer's tort liability, emphasizing that we should protect both legal interests of the victims and the employers during the legislation process of employer' s tort liability, according to the fair principle. Besides these, the author analyzes the ele- ments which consist of the employer' s tort liability.
