我国教育立法的现状与教育司法的对策

The Status Quo of Legality in China and the Corresponding Counter-measures

法制是现代社会的重要标志。国家的现代化建设离不开法制的保障。在弘扬依法治国的今天 ,也必然要求教育依法而治。本文着重分析了我国教育立法的现状和存在的问题 ,并从法制建设的维度 ,提出了相应的教育司法对策 。

This article shows that legality is the significant,symbol of modern society. The modernization construction of our country cannot do without the guarantee of legal system. Under these circumstances of promoting and developing the general plan of administering the country according to law, education is inevitably to be admininstered in accordance with law. This essay emphatically analyzes the current situation and the existing problems of educational legislation in China, and from the dimension of the construction of legal instituions, provides some corresponding counter- measures on educational administration of justice, in order to promote both the perfection of our country's educational legislation and the amplification of educational administration of justice.
