摘要
我国法律法规未明确规定不动产登记错误赔偿责任的归责原则,相关规定的文字表述亦不一致,以致司法实践中同案不同判的现象时有发生。为统一司法,应以《物权法》、《国家赔偿法》、《房屋登记办法》等相关规定为参照,运用体系解释的方法确立不动产登记错误赔偿责任的归责原则。
The laws and regulations of China don't stipulate the principle of imputation of the damage liability in the registration of real estate, and the relevant provisions are inconsistent, so that the different sentence of the similar cases in the judicial practice occurred from time to time. We should establish the principle of imputation of the damage liability in the registration of real estate by reference to the Property Law, the State Compensation Law and the other relevant regulations and use the method of systematic interpretation.
