关于新《刑事诉讼法》“依法不负刑事责任的精神病人的强制医疗程序”一章司法解释的解读

On the Interpretation of the Judicial Explanation of the Chapter "Compulsory Medical Procedures for Mental Patients with no Criminal Responsibility in Accordance with the Law" in New Criminal Procedure Law

2011年新修改的《刑事诉讼法》设专章规定了"依法不负刑事责任的精神病人的强制医疗程序",其看似简单的六个条文却涵盖了强制医疗的适用对象、适用条件、审理程序、监督机构等诸多内容,但仍旧较为原则。为了弥补其太过原则性的缺陷,2012年11月通过的《最高人民法院关于适用<中华人民共和国刑事诉讼法>的解释》又对其进行了解释;解释后的条文虽然相比之前更加细化与全面,但司法解释背后的原理以及在实践中如何把握与适用等仍需要解说。本文即尝试对之进行阐释。

＂Compulsory Medical Procedures for Mental Patients with no Criminal Responsibility in Accordance with the Law＂ is stipulated separately in the newly modified Criminal Procedure Law in 2011. In this chapter, the seemingly simple six provisions covers the applicable objects, applicable conditions, trial process, supervision agencies, etc.. However, the provisions are still relatively in principle. In order to make up for the defect of over principle, the provisions were explained in ＂The Explanation by the Supreme People ＂s Court about the Ap- plication of the ＂Criminal Procedure Law of the People＇s Republic of China＇＂passed in November, 2012. Though the explained provisions are more detailed and comprehensive than before, the principle behind judicial interpretation as well as how to grasp and apply in practice still need explanation, which is this paper＇s intention.
