摘要
2006年10月欧共体理事会通过第1419/2006号条例,废除班轮公会反垄断集体豁免,将《欧共体条约》一般性竞争法规则适用于海运市场,引发了欧盟海运竞争法体系的根本变革。欧盟海运竞争法律体系的变革引发了国际社会对于海运竞争立法的重新评估,中国应当通过评估欧盟限制航运反垄断豁免,将航运市场纳入一般竞争法的这一做法,立足于国家航运与贸易利益的角度来确立自己的航运反垄断规则。在定位起草中的《航运法》反垄断规则的立法走向时,欧盟将一般竞争法规则适用于海运市场的做法值得引为借鉴。
In October 2006 EEC passed Regulation 1419/2006, repealed block exemption of liner conferences, and applied general competition rules to the shipping industry, which have resulted in fundamental reform in EU shipping competition law. The transformation of EU shipping competition legal system led to a worldwide re-evaluation of shipping competition law. Based on state shipping and trade interests, China should make its own shipping anti-monopoly rules through assessing the transformation of EU shipping competition law. When Chinese shipping anti-monopoly rules are drawn up EU's application of general competition rules to the shipping sector deserves learning by China.
