摘要
本文是以未中标的供应商在政府采购过程中寻求救济的行政程序进行分析,重点对其在质疑和投诉这一阶段如何得到良好的法律保护进行分析。通过分析,本文认为要将质疑程序应改为质疑任意主义,以实现以双方沟通解决问题为优先,以避免时间耗费导致救济迟缓;对于投诉阶段,重点就是审查机构的建立,结合世界各国的立法,应参考建立具备独立性和专业性的审查机构。
This paper carried out analysis on seeking administrative procedures of relief for supplier of losing tender in the process of government procurement, and focused on the analysis on how to get good legal protection in the stage of questions and complaints. By analysis, this paper argues that to challenge procedures should be changed to challenge arbitrariness doctrine, in order to achieve the communication between the two sides to solve the problem as a priority, and avoid time-consuming causing slow relief; For the complaint stage, the focus is the review of the establishment of the institutions, combined with the legislation of the world, should refer to establish review organization with independence and professionalism.
