摘要
社会监管是以健康卫生、安全、环境保护等社会价值为目标的政府监管行为。通过西方国家社会监管制度的考察与经验梳理,由此反思我国社会监管制度在"反向制度变迁"中所面临的困境,进而提出了相应的路径选择。在现实国情下,试图理想化地解决社会监管问题乃是一厢情愿的事情,唯有采取理性与宽容的精神对待社会监管的技术层面设计,方能更好地发挥"倒逼机制"作用,借此推动制度层面的顶层设计。
Social regulation is a kind of government regulatory behavior with the goal of the health, safety, environmental protection and other social value. After reviewing the western social regulation system and its experience, we should reflect that China＇ s social regulation system has been facing the dilemma in the ＂reversed institutional change＂, and then put forward the corre- sponding path selection. Under the practical Chinese condition, it is a wishful thing to attempt to solve social regulatory issues ideally. We should only take the spirit of the rationality and tolerance to treat the technical design of social regulation, in order to better play a role of ＂reversed transmission mechanism＂, for promoting the top-level system design of social regulation.
