合作行政:服务行政行为的一种模式

Cooperation Administration: A Mode for the Service-oriented Administration

当代行政法的变革在理念上呼唤着契约精神,在理论研究上催生着合作行政,在实践中也呼应着合作行政;同时,为适应当前我国的服务型政府建设热潮,行政行为模式也要由服从行政到协作行政再演变到服务行政。作为服务行政行为的一种模式,合作行政有助于社会本位的外化和实现,有利于最大限度推动民主行政,并可以有效促成公共服务和有限政府的统一。

The contemporary administrative law reform calls for the spirit of contract in the ide- a, promotes cooperation administration in the research and echoes the cooperation administration in the practice. At the same time, the administration pattern should transfer service-oriented adminis- tration from subordinate administration and cooperation administration, in order to adapt to the con- struction of Chinese service-oriented government. As the mode of service-oriented administration, the cooperation administration contributes to externalizing and realizing the social standard, maximal- ly promoting the democratic administration and effectively unifying the public service and the limited government.
