摘要
律师广告有其存在的合理性,但因其存在虚假性和欺诈性风险,并且律师行业又存在行业特殊性,律师广告需要受到合理规范。律师广告规范主要是从原则与规则两方面入手。文章通过比较法的视角对律师广告规范的原则与规则进行探析。律师广告原则包括:真实性原则、非误导性原则、适当性原则和比例原则。律师广告规则主要由内容与方式构成。在明确律师广告规范的原则与规则之后,对我国律师广告规范的现状进行分析,找出问题,并提出解决对策。
Lawyer advertising has the existing reason. Otherwise, because of the risk of false and fraudulent, lawyer advertising should be regulated reasonably. What's more, the legal profession is a particular profession. Lawyer advertising mainly includes two aspects cf the principles and rules. By perspective of Comparative law,the principles and rules of law- yer advertising norms are analyzed. Lawyer advertising principles include: truth/ulness, non-misleading, appropriateness and proportionality. Lawyer advertising rules are mainly constituted by the content and method. Then, the present situation of China is analyzed ,and the problems are identified. Finally, the solution is proposed.
