Recently, Australia＇s anti-smoking legislation required cigarettes to be sold in plain packaging, which brought about quite a lot of controversy. This measure is reasonable from the perspective of public health. The UK, New Zealand and Canada intend to take similar measures. The legislation would prohibit tobacco industry logos or brand images, which encountered fierce opposition. The influence of the legislation on both the intellectual property rights of the tobacco industry and the international protection of trademarks will be discussed in the article.
