从人肉搜索看信息时代公民隐私权的保护

The protection of privacy right in the information times from the perspective of human flesh search

人肉搜索作为一种不同于传统搜索引擎的新型搜索方式发展相当迅速,在发挥积极作用的同时也导致了很多负面的社会问题,最突出的就是对公民隐私权保护提出了前所未有的严峻挑战。通过对人肉搜索中侵权行为的法律分析,分别从网民的自我保护意识和自律精神、网络服务商的义务以及网络实名制三个方面提出完善公民隐私权保护的建议。

Human flesh search has developed very fast as a new search way which is different from the traditional search way.It plays an active role in the social supervision,but it also causes many negative social problems,the most prominent of which is the unprecedented challenge on protection of privacy right.This paper does legal analysis of tort caused by the human flesh search and puts forward suggestions about perfecting the protection of privacy right in light of the user's awareness and self-regulation,the obligation of network service provider and the network real-name system.
