美国修改强奸罪定义的法理意义

The Legal Significance of Modifying Definition of Crime of Rape in USA

美国联邦调查局根据搜集到的一些犯罪数据信息对强奸的定义作了修改,首次把鸡奸男性、强迫口交乃至"女奸女"等行为纳入强奸定义之中,扩大了强奸一词的统计定义。在我国,鉴于实践中时有男子遭受女性强奸而刑法规定涵盖不全的情况,建议采用美国的做法,将《刑法》第236条作些修改,扩大强奸罪的犯罪主体,将更多奸淫行为纳入犯罪评价体系。

Federal Bureau of Investigation （FBI） modified the definition of rape based on some criminal data information collected, which was the first time to include some behaviors such as sodomy of males, forced oral sex and rape happened between females, etc into the definition of rape, expanding the statistical range of rape. In China, considering the fact that males are occasionally raped by females and the criminal law doesn＇ t cover completely, I suggest that we modify some points of article 236 under the criminal law to expand the subject of crime of rape and include more adultery behaviors into crime evaluation, following USA.
