The People's Court and Social Management Innovation

从历史和现实来看,法院都是行使社会管理职能的重要国家机关,所以社会管理创新离不开人民法院的参与。人民法院参与社会管理创新能实现程序公正和实体公正,实现看得见的正义;在有限的司法资源条件下提高司法效率,促进案件的快速解决;还能实现法律效果和社会效果的统一,促进社会的和谐稳定。人民法院参与社会管理创新的主要途径是能动司法,诉讼外参与大调解等与审判管理创新并举,妥善积极化解社会纠纷和矛盾,通过各种渠道,使民众方便、快捷地接近司法,确保司法公开,实现司法更好地为民众服务。

From the historical and realistic viewpoint,the People＇s Court is an important state organ which exercised the function of social management,so social management innovation cannot do well without participation of the People＇s Court.The People＇s Court participating in social management innovation could promote procedural justice and substantive justice,realize visible justice,improve judicial efficiency in the conditions of limited judicial resources,promote case resolving fast,achieve the object of unity of legal and social effect,and promote social harmony and stability.The People＇s Court participating in social management innovation has three main approaches： active justice,participating big mediation and trial management innovation,making people access the justice easily and quickly through various channels,ensuring publicity of justice,and realizing justice better service for the public.
