摘要
《最高人民法院关于审理道路交通事故损害赔偿案件适用法律若干问题的解释》第15条对道路交通事故财产损害赔偿的范围予以了明确的规定。据此,道路交通事故财产损害赔偿的范围主要包括修理费、重置费、停运损失以及使用中断损失等。鉴于车损案件在司法实践中的复杂性,上述规定特别是有关各项赔偿项目的内容、赔偿条件、计算标准等尚需作更加细致的解读,以更好地平衡和保护当事人的利益,解决当事人之间的纠纷。
According to Article 15 of Interpretation on Several Issues Concerning the Laws Appli- cable to the Damages Disputes in Road Traffic Accidents, the damages in road traffic accidents main-ly include repair costs, replacement costs, loss on business interruption, and loss on usage interrup-tion. Due to the complexity of vehicle damage cases in juridical practice, the article needs a more detailed interpretation, especially on the content, condition and the calculation standard of the damage com-pensation stated above, to balance and protect the interests of both parties involved and to resolve the disputes.
