基于大学衍生企业创业的专利权制度比较研究 被引量:9

摘要 大学衍生企业创业是提高专利转化率的一种有效方式,而专利权制度是影响衍生企业创业的关键因素。长期以来,杜拜法条件下的专利权安排一直是各国效仿的对象,但争议不断。通过对美国大学技术管理协会(AUTM)数据的统计分析和文献回顾,发现现有大学所有制对大学衍生企业创业有积极影响,但受到大学技术转移办公室(TTO)管理水平的制约;大学所有制并非专利制度的最佳安排,科研人员所有制更有利于衍生企业创业。研究结果对我国政府与大学科研管理者、科研人员有启示作用。
